The point about the Market Type is that there were no users or vendors who were doing this. There was no market for doing this. It was something completely foreign and new.

Which is a little ridiculous, because if someone did rip your thing off, what could be better publicity for it than the ensuing controversy? If you can, design for circumstances where, once youre ready to start talking about your idea, youre encouraging people to "disclose" your efforts. And that shouldnt require a contract at all.
